1. Agreement to Terms

By accessing or using the SurveyNode platform ("Service") operated by ESJ Software Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service.

2. Description of Service

SurveyNode is an AI-powered survey and feedback collection platform that enables:

  • Creation and distribution of surveys
  • Collection of responses via web and WhatsApp
  • AI-assisted conversational survey experiences
  • Analytics and reporting on survey data

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Service. By using the Service, you represent that you meet these requirements.

4. Account Registration

4.1 Account Creation


  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You must notify us immediately of any unauthorized access

4.2 Account Types


  • Organization accounts: For businesses and organizations
  • Team members: Users invited to an organization account

5. Acceptable Use

You agree NOT to:

  • Violate any applicable laws or regulations
  • Collect data from minors without appropriate consent
  • Use the Service for spam, phishing, or fraudulent purposes
  • Attempt to access other users' data without authorization
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Use the AI features to generate harmful or illegal content

6. Intellectual Property

6.1 Our Property


The Service, including all software, designs, and content created by us, is our intellectual property protected by copyright, trademark, and other laws.

6.2 Your Content


You retain ownership of surveys you create and responses you collect. By using the Service, you grant us a license to process and display this content as necessary to provide the Service.

6.3 Feedback


Any suggestions or feedback you provide may be used by us without obligation.

7. Payment Terms

7.1 Subscription Plans


  • Plans are billed monthly or annually as selected
  • Prices are in GBP unless otherwise specified
  • All fees are exclusive of taxes unless stated

7.2 Billing


  • You authorize us to charge your payment method
  • Failed payments may result in service suspension
  • No refunds for partial billing periods

7.3 Plan Changes


  • Upgrades take effect immediately
  • Downgrades take effect at the next billing cycle

8. Data Processing

8.1 Your Responsibilities


As a survey creator, you are the data controller for responses collected through your surveys. You must:
  • Obtain appropriate consent from respondents
  • Comply with applicable data protection laws
  • Use collected data only for stated purposes

8.2 Our Role


We act as data processor for survey response data and will process it according to our Data Processing Agreement.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with advance notice
  • Make emergency changes without notice
  • Modify or discontinue features with reasonable notice

10. Termination

10.1 By You


You may cancel your account at any time through account settings.

10.2 By Us


We may suspend or terminate your account for:
  • Violation of these Terms
  • Non-payment of fees
  • Extended inactivity
  • Legal requirements

10.3 Effect of Termination


Upon termination:
  • Your access to the Service will end
  • You may export your data for 30 days
  • We may delete your data after the export period

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our liability is limited to the fees paid in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for loss of data, profits, or business opportunities

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights
  • Survey content you create

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England and Wales, except where consumer protection laws require otherwise.

14. Dispute Resolution

Before initiating legal proceedings, you agree to attempt resolution through:

  • Direct communication with our support team

  • Mediation if direct resolution fails

    We may modify these Terms with at least 30 days' notice. Continued use after changes constitutes acceptance. Material changes will be communicated via email.

    16. General Provisions

    • Entire Agreement: These Terms constitute the complete agreement
    • Severability: Invalid provisions do not affect other provisions
    • No Waiver: Failure to enforce a right does not waive it
    • Assignment: You may not assign your rights without our consent
